Notice of Hire Standards Earned Sick and Safe Time (ESST) – Accrual Policy and Procedure (Effective January 1, 2024)

As of January 1, 2024, Hire Standards provides up to a maximum of 48 hours of Earned Sick and Safe Time to employees who have worked 80 or more hours within 12 months of their anniversary date of employment with the company.

Eligibility and Policy
 
All employees who have worked 80 or more hours with Hire Standards within 12 months of their Anniversary date with the company will start accruing ESST time. Eligible employees will accrue one hour of ESST time for every 30 hours worked up to a maximum accrual of 48 hours, per Anniversary year.
 
Accrued, unused time under this policy will carry over each year up to a maximum accrual of 80 hours.
 
Leave under this policy may be used in connection with the diagnosis, care or treatment of an existing health condition for, or the preventive care of, an employee or an employee’s immediate family member. “Family member” for purposes of this policy includes spouses, registered domestic partners, children (regardless of age), parents (including step-parents and parents-in-law), grandparents, grandchildren, siblings or a designated person. Leave under this policy may also be used for employees who are the victims of domestic violence, sexual assault or stalking.
 
It is VERY IMPORTANT for you to report an absence or tardiness to Hire Standards prior to the absence if foreseeable or as soon as possible within 24 hours of the absence or tardy. You will be required to actually take the time off to be paid for ESST hours.
 
Employees requesting time off under this policy should provide as much advanced notice to a Hire Standards staff member as possible by contacting a Hire Standards staff member to complete the Earned Sick and Safe Time Request Form or email the completed form to a staff member.
 
In the event that advance notice is not possible to a Hire Standards staff member, then you must notify Hire Standards within 24 hours of the missed work time, if you would like to use ESST time for your absence. You can notify Hire Standards by calling the office at 612-822-6672 to speak with a staff member or leave a voicemail, texting our office, or emailing Hire Standards. If you do not notify Hire Standards within 24 hours of your missed work time that you were absent for an eligible reason and would like to use ESST time, then your absence will be considered a non-excused absence or job abandonment on your record and may affect your future employment with Hire Standards. If you do notify Hire Standards within 24 hours of the missed work time that you were absent for an eligible reason, you will be paid the amount of requested and accrued ESST hours according to the accrual policy. You will not be paid for hours that have not been accrued and you will be required to actually take the time off to be paid for ESST hours.
 
Unused time under this policy is not paid out at the time of separation from employment. Employees who are re-employed with Hire Standards and have work hours within a 180-day separation period will be reinstated with previously accrued and unused ESST hours. If you do not re-employ and have work hours with Hire Standards before 180 days, your accrued ESST time will be forfeited (lost) and your ESST hours balance will go to zero.
 
***As of January 1, 2024, this new ESST Policy replaces any previous Paid Time Off (PTO/Vacation Pay) policy that was in place.
